The personal data protection is a fundamental right that derives from article 18(4) of the Spanish Constitution and which has been confirmed as such by the Constitutional Court in the year 2000 (CCS 292/2000, November 30). This fundamental right is regulated in Spain mainly in the Personal Data Protection Act (PDPA, “Ley Orgánica 15/1999, de 13 de December 13”) and in the Royal Decree 1720/2007, December 21, which approves the implementing regulations of the Personal Data Protection Act.
